Can a collegiate wrestler get sued for doing a legal move that permanently injures the opponent?
Can a collegiate wrestler get sued for doing a legal move that permanently injures the opponent? During the sectional finals in Massachusetts a kid was backpacking me (riding legs while I was in a tripod position while I was trying to shake him off.) He was 1/2 way off my back (his head was dangling over mine), so I decided to jump so the kid hit his head/neck against the mat. He laid on the ground for a while as the injury time ran. Eventually he got up uninjured. I was wondering if I could get in any trouble if the kid broke his neck, and was permanently injured.
It wouldn't be a criminal act, you both entered in to a sanctioned "fight" understanding there were possible risks and agreed to them. Now if it wasn't done at a competition that would fall under different rules, but that is beside the point. The problem is that Civil matters are different then criminal matters. The family likely would try to sue and you'd need a lawyer to defend it. I'm sure they'd find some lawyer that would hold you responsible, even if they had to pay him. Lawyers will take most cases if they are paid.
